The agreement

These Terms of Service govern your access to and use of the Operion engineering analytics platform and related websites (the “Service”). By accessing or using the Service, you agree to these terms. If you are agreeing on behalf of an organization, you represent that you have authority to bind that organization.

Your account

  • Provide accurate account information and keep it current.
  • Safeguard your credentials; you are responsible for activity under your account.
  • Notify us promptly of any unauthorized use.

Your data

You own your data. We process it only to provide the Service.

  • You own the data you submit or that we ingest from sources you connect.
  • You grant Operion a limited license to process that data solely to provide and support the Service.
  • You are responsible for having the rights to connect a data source and allow Operion to process its data.
  • Where we process personal data on your behalf, our Data Processing Agreement applies.

Acceptable use

  • Do not use the Service in violation of any law.
  • Do not attempt to access other customers’ data or circumvent tenant isolation.
  • Do not probe, scan, or test the security of the Service without authorization.
  • Do not reverse engineer or copy the Service except as permitted by law.
  • Do not interfere with or disrupt the integrity or performance of the Service.

Fees and payment

  • Fees are as stated in your order or on our pricing page.
  • Payments are handled by our payment provider.
  • Unless stated otherwise, fees are billed in advance and are non-refundable except where required by law.
  • We may change fees on renewal with reasonable prior notice. You are responsible for applicable taxes.

Warranties and liability

The Service is provided “as is” and “as available” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and each party’s total liability is limited as set out in the final published terms.

Changes and contact
